NEW DELHI: In a letter dated October 3, Soumya Aich Roy, a Congress leader from West Bengal, has urged Governor CV Ananda Bose to take action against MLA Humayun Kabir of Bharatpur and MP Yusuf Pathan of Berhampur.
Roy alleges that the two politicians have engaged in polarizing voters along religious lines to secure victory in the upcoming 2024 general elections.
Roy's letter specifically refers to a statement made by Humayun Kabir, in which he allegedly explained how they polarized voters based on religion to win the general elections.

The Congress leader argues that this statement not only caused unrest but also violates laws and the constitution.
"In Section 196 of The Bharatiya Nyay Sanhita 2023 it is clearly said that promoting enmity between different groups on grounds of religion, race is a punishable offence. Article 19 of the Constitution of India clearly says that Freedom of Speech is restricted when it violates the sovereignty and integrity of India. An elected MLA has to swear that he will uphold the sovereignty and integrity of India, but Mr Humayun Kabir didn't work as per his oath," Roy stated in the letter.

The Congress leader raises questions about why Humayun Kabir's membership in the West Bengal Legislative Assembly should not be cancelled and why the election results of the Berhampur Lok Sabha constituency in 2024 should not be declared void. Roy seeks the Governor's attention on this matter.
In the 2024 general elections, Trinamool Congress leader Pathan Yusuf emerged victorious from the Baharampur parliamentary constituency, securing 524,516 votes and defeating Congress leader Adhir Ranjan Chowdhury.
